ARTICLE 1064 CIVIL CODE - COMMON FEES ARE PAID BY SHARE

Too many times, we have witnessed a situation where an assessment to co-owners was made by a Board of Directors on equity instead of relative value.  Something like:

1- "Well, we have heard this guy has a larger private portion than anyone else and in our opinion he should support a greater share of common expenses.  At the same time, it is a relief for other less fortunate co-owners". Or,

2-  Well, we are only fifteen co-owners on three floors:  5 on each floor.  There is only of difference of 5% between the relative value of the first, second and third floor.  First floor pays a bit more and third floor a bit less and all are happy".

Good thinking, bad decision!
